THE RULES OF THE CLUBHOUSE.

You must provide a valid email address and keep your password secure. You're responsible for activity that happens under your account. You must be at least 13 years old to use PingAces. If you are under the age of legal majority where you live, your parent or guardian must agree to these terms and supervise your use.

Pick a username you have the right to use — don't impersonate other golfers, clubs, or brands.

PingAces is a community built around golf. You agree not to:

• Post content that is unlawful, hateful, harassing, or sexually explicit.
• Spam members, scrape the service, or create fake accounts.
• Upload content you don't have the rights to share.
• Attempt to access other members' accounts or data.
• Interfere with the operation or security of the service.

Zero tolerance. There is no place on PingAces for objectionable content or abusive users. Anyone can report a post, comment, message, profile, group or tee-up, and block any member. We review reports and act within 24 hours — removing content and banning accounts that break these rules.

Follow our Community Guidelines, which form part of these terms. We may review reports, remove or restrict content, and suspend or terminate abusive accounts. Nudity, threats, hate, scams, impersonation and sharing another person's private information are prohibited. Reports and blocking support our zero-tolerance approach to objectionable content and abusive users.

You own the posts, photos, scores, and other content you share on PingAces. By posting, you grant PingAces a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate the service — for example, showing your posts in other members' feeds.

You are responsible for your content, its accuracy, necessary permissions and compliance with law and these terms. Do not upload material that infringes intellectual property, privacy or other rights. This license is only for operating and providing PingAces, not a transfer of ownership.

Deleting your content ends this license going forward, except where the content has been shared by others or we must retain it for legal reasons.

Scorecards, statistics, averages, and trends on PingAces are calculated from the scores you and other members enter. They are provided for personal and social use only — PingAces is not an official handicapping authority, and stats shown in the app are not official handicap indexes. You're responsible for the accuracy of the scores you log.

The PingAces name, logo, and brand assets, and the design and code of the service, belong to PingAces. These terms don't give you any right to use them except as part of using the service.

You can stop using PingAces and delete your account at any time. We may suspend or terminate accounts that violate these terms or that we reasonably believe put the service or other members at risk.

PingAces is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the service will be uninterrupted, error-free, or that any golf statistics will be accurate.

To the fullest extent permitted by law, PingAces will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the service.

Send copyright infringement notices to support@pingaces.com, attention: Copyright. Include your physical or electronic signature; identification of the copyrighted work; identification and location of the allegedly infringing material (such as the post link); your address, telephone number and email; a good-faith statement that the use is not authorized by the owner, agent or law; and a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner.

We may remove material, notify the uploader and terminate repeat infringers. A counter-notice should identify the removed material and former location, include your signature, contact details, a statement under penalty of perjury that removal resulted from mistake or misidentification, and consent to the jurisdiction of the applicable US federal district court and acceptance of service from the complainant. We handle valid notices and counter-notices under applicable law. False notices can create liability.

To the extent permitted by law, you agree to indemnify and hold PingAces and its operators harmless from third-party claims, losses and reasonable expenses arising from your unlawful content, infringement of others' rights or material violation of these terms. This does not require indemnification for PingAces' own wrongful conduct or override mandatory consumer protections.

These terms are governed by New York law, without regard to conflict-of-law rules, except where mandatory local consumer law applies. First contact support@pingaces.com so we can try to resolve a dispute informally. If unresolved, disputes may be brought in courts with competent jurisdiction in New York, subject to any mandatory right to use courts where you live. Nothing here imposes mandatory arbitration, prevents small-claims proceedings or waives non-waivable consumer rights.

If you download PingAces through Apple's App Store, this agreement is between you and PingAces, not Apple. Your license is non-transferable, for Apple-branded products you own or control as allowed by Apple's Usage Rules, including applicable Family Sharing or volume-purchase rules. PingAces, not Apple, is responsible for the app, maintenance/support and applicable product, intellectual-property and legal claims.

Apple has no obligation to provide maintenance or support. To the extent a warranty cannot be disclaimed, you may notify Apple of a failure to conform and Apple may refund any app purchase price; Apple has no other warranty obligation to the maximum extent permitted by law. Apple is not responsible for the service or member content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You must comply with applicable third-party agreements and not be located in a country subject to a US government embargo or designated as supporting terrorism, or be on a US prohibited/restricted-party list. These terms do not override Apple's applicable minimum EULA requirements or your mandatory rights.

We may update these terms as PingAces evolves. We'll update the date above and, for material changes, notify members in the app. Continuing to use PingAces after a change means you accept the updated terms.
